On February 19, Manhattan Supreme Court Justice Shirley Kornreich ruled against Kesha in her sexual harassment lawsuit involving longtime producer Dr. Luke and her label, Sony Music Entertainment. Kesha pleaded in the New York Courtroom for an injunction that would allow her to release music independently from her producer, whose real name is Lukasz Gottwald, but the request was ultimately denied.
According to the contract she signed with Sony, Kesha must record six more albums with Sony, who employs Dr. Luke. The pop star has made multiple accusations about her producer mentally and physically abusing her, and claims Dr. Luke pressured her to lose weight when he wasn’t happy with her appearance in a music video.
Friday’s ruling sparked opposition by many Kesha fans on social media. The hashtag #FreeKesha was trending all day on Friday after pictures of Kesha crying in the courtroom were posted online.
“You’re asking the court to decimate a contract that was heavily negotiated and typical for the industry,” said Justice Kornreich to Kesha’s lawyer, according to the Hollywood Reporter. Kesha signed her contract with Gottwald and Sony in 2005, when she was 18 years old.
Justice Kornreich also reviewed the reports of sexual harassment Kesha filed against Dr. Luke, but dismissed the claims until Kesha’s team can file more proof. The accusations of sexual harassment go back up to 10 years, when the singer and producer first met. Gottwald’s attorneys have argued that Kesha’s claims have not been consistently reported: Justice Kornreich cited the lack of sufficient evidence, such as hospital records, that would have detailed any reported assaults.
Although Sony has given Kesha the option to record with another producer, her lawyer called this deal “an elusive promise.” Her team believes Sony will not promote her music enough to maintain the standard of fame she has achieved thus far if she works with someone else other than Dr. Luke.
Along with her fans’ support, many celebrities tweeted encouraging words for Kesha after the court’s decision was announced. Lady Gaga, Demi Lovato and Ariana Grande are just some of the big names who offered kind words to the “Tik Tok” singer.
“There are people all over the world who love you @KeshaRose,” wrote Gaga on Twitter. “And I can say truly I am in awe of your bravery.”
Taylor Swift has not tweeted any supporting words for her pop star peer, but, according to Rolling Stone, a representative for Swift reported that she donated $250,000 to Kesha. Swift, who once stated, “There’s a special place in hell for women who don’t support other women,” during an interview with Vanity Fair, seems to be playing her part in uplifting her female colleagues. Kesha’s mom confirmed the donation, tweeting her sentiments.
Demi Lovato, who has worked with Dr. Luke in the past, tweeted “#FreeKesha this is only gonna make you stronger, you brave and beautiful girl. Prayers are with you @KeshaRose.” She was not as empathetic, however, to Swift’s actions.
“Take something to Capitol Hill or actually speak out about something and then I’ll be impressed,” tweeted the “Cool For The Summer” songstress, calling out Swift for not directly addressing sexual abuse against women in the industry. She also clarified her point of view responding to a fan’s comment about the “shady” tweet, saying, “I didn’t shade Taylor … I’m just tired of seeing women use ‘women empowerment’ and ‘feminism’ to further brands without actually being the ones that have the uncomfortable conversations.”
Dr. Luke also took to Twitter himself to defend his position.
“I understand why people without all the information are speaking out,” wrote the producer on Twitter. “I can appreciate their compassion … I didn’t rape Kesha and I have never had sex with her. Kesha and I were friends for many years and she was like my little sister.”
Both sides will now have until March 21 to submit evidence and the pop singer will then have to wait to see if the case will go to trial.
